Terms of Use and End User License Agreement

1. Provider
Tanly is provided by mehrbytes GbR, Mika Ramsl and Mats Ramsl. You can contact us at info@mehrbytes.com. These Terms govern the use of the Tanly app and the related website at tanly.mehrbytes.com.

2. Subject of the App
Tanly is a UV weather app and personal sun journal. The app allows users to manage UV values, sun time, SPF settings, reminders, widgets, and personal journal entries.

Tanly does not provide medical advice in any form. The app is intended exclusively for general orientation and personal documentation. Tanly does not replace advice, diagnosis, or treatment by doctors, dermatologists, or other medical professionals.

3. No Medical Recommendations
Information, notices, reminders, and calculations shown in Tanly are based on weather data, UV data, user input, and technical estimates. They must not be understood as medical recommendations, health advice, or binding safety instructions.

Users are responsible for assessing their own time in the sun and taking appropriate protection measures. If you have health questions, skin changes, sunburn, or any uncertainty, you should seek medical advice.

4. Internet Connection and Third-Party Data
Some features of Tanly require an active internet connection, especially features that display UV, weather, or location-based information. If your device is offline, if network access is unavailable, or if your mobile data allowance is exhausted, parts of the app may be limited or unavailable.

UV and weather information may be provided by external data sources. Although Tanly aims to present useful and current information, these data sources may be delayed, incomplete, unavailable, or inaccurate. Tanly does not guarantee that UV or weather data is always correct, complete, or suitable for a specific situation.

5. Use of the App
The app may only be used in accordance with applicable laws and these Terms. Users must not misuse, manipulate, reverse engineer, scrape, automate access to, or use the app for unlawful purposes.

6. Journal Content and User Input
Users may store personal information and journal content in Tanly, such as sun time, tracking times, notes, SPF information, skin type settings, locally selected photos, or similar information.

This personal journal content remains stored locally on the user's device. Tanly does not upload, review, analyze, or otherwise process user-added photos, tracking times, session data, notes, or similar personal entries on its own servers. Users are responsible for the accuracy of the data they enter. Tanly does not guarantee that displays derived from user input are complete, correct, or suitable for a specific situation.

7. Availability, Updates and Technical Changes
Tanly is provided with reasonable care. However, uninterrupted, error-free, or permanent availability is not guaranteed. Features may be changed, expanded, restricted, or removed where this is necessary for technical, legal, or business reasons.

Tanly may require updates to remain secure, compatible, or functional. We do not guarantee that the app will remain compatible with all older iOS, Android, device, or operating system versions indefinitely. We may stop supporting outdated versions of the app or certain operating systems where this is necessary for technical, security, legal, or business reasons.

8. Paid Features and Subscriptions
Tanly may include free and paid features. Paid features may be unlocked through in-app purchases or subscriptions.

For purchases through the Apple App Store or Google Play Store, the terms of the respective store provider also apply. Subscriptions renew automatically depending on the selected model unless they are cancelled in time through the settings of the respective store provider.

Managing, cancelling, and requesting refunds for App Store or Play Store purchases is generally handled through the relevant store provider.

9. Prices and Changes
The applicable prices are shown in the App Store or Play Store. Prices may vary depending on country, currency, taxes, and store requirements.

Tanly may change prices or the scope of services for future billing periods. Existing subscriptions are handled according to the rules of the respective store provider.

10. Withdrawal and Refunds
Digital content, in-app purchases, and subscriptions may be subject to special statutory and store-specific rules. Refund requests for purchases through Apple or Google should generally be directed to the relevant store provider.

11. Rights in the App
All rights in Tanly, including design, text, graphics, source code, trademarks, logos, and other content, remain with the provider or the respective rights holders.

Users receive only a personal, non-transferable, revocable right to use the app within the scope of these Terms.

12. Apple End User License Agreement
If Tanly is downloaded through the Apple App Store, the Apple Media Services terms and Apple's standard end user license agreement also apply, unless a different agreement is effectively included.

13. Liability
Tanly accepts no liability for damage resulting from users understanding the app as medical advice, misinterpreting notices, relying on inaccurate weather or UV data, or conditions changing at short notice.

By using Tanly, users acknowledge that Tanly and its developers are not responsible for sunburn, skin damage, or other adverse effects resulting from sun exposure. The information provided by the app is for informational purposes only and should be used together with the user's own judgment and appropriate protective measures.

Liability for damage to life, body, or health remains unaffected. Mandatory statutory liability also remains unaffected.

14. External Services
Tanly uses external technical services, including services for hosting, analytics, error diagnostics, and payment processing. Further information is available in the Privacy Policy at tanly.mehrbytes.com/privacy.

15. Privacy
Information about the processing of personal data is available in the Privacy Policy at tanly.mehrbytes.com/privacy.

16. Changes to these Terms
Tanly may update these Terms where necessary due to technical, legal, or business changes. The current version will be made available on the website.

17. Applicable Law
The laws of the Federal Republic of Germany apply, unless mandatory consumer protection rules provide otherwise.
